Foundation Events "One Step Closer" Stair Climb
Stair Climb event participants must accept the following waiver. Registered climbers will receive a copy that can be used for practice sessions at the event site. The Bank of America Tower will be open for training prior to the climb. Climbers may practice from 8 AM to 8 PM, Monday through Friday. They should check in at the guard desk by the elevators and present your your Waiver of Liability before ascending the stairs. Waiver of Liability: I hereby waive all claims against the Celma Mastry Ovarian Cancer Foundation, all sponsors, including One Progress Plaza II, LLC, any volunteers and any personnel for any injury I might suffer in this event or in practice for this event. I understand that this event requires extremely rigorous and strenuous physical activity by participants and that participating in such activities can be inherently dangerous to individuals with adverse medical conditions or who are insufficiently physically conditioned to participate. I hereby represent that I assume all responsibility for myself in these regards and knowingly assume all liability therefore. This Hold Harmless and Indemnification Agreement ("Agreement") is entered into by and between Participant desires to utilize Owner's premises located at 200 Central Avenue, St. Petersburg, Florida, for an event known as Celma Mastry Ovarian Cancer Foundation "One Step Closer" Stair Climb, to be held on Saturday, September 13th, 2008. The intent of this Agreement is to indemnify Owner and Organizer from any and all claims arising from or related to Participant's use thereof. IN CONSIDERATION OF $10.00 AND OTHER VALUABLE CONSIDERATION, THE RECEIPT AND SUFFICIENCY OF WHICH IS HEREBY ACKNOWLEDGED, Participant , Owner, and Organizer, agree as follows: 1. Participant will indemnify and hold harmless Owner and Organizer and their agents, employees, subsidiaries, affiliates, directors, officers, members and managers, from any and all claims, actions, liability, loss, damages and judgments, including all costs of defense and attorney's fees incurred in defending against same, arising from and related to Participant's and Participant's agents, employees, invitees and contractors use of any Owner asset, whether arising from the negligence of Owner, or otherwise. 2. Owner shall be entitled, in its reasonable discretion, to settle any and all claims and in such event Participant shall indemnify and hold harmless Owner for any such claims paid, including Owner's reasonable attorney's fees and related expenses incurred resulting from such claim. 3. This Agreement shall be interpreted under the laws of the state of Florida. Venue shall be in Pinellas County. This Agreement shall be binding on and inure to the benefit of the heirs, executors, administrators, successors and assigns of the respective parties hereto.
